The paper argues, first, that even incompatible normative claims can be inferred from the silence of the legislature, and, secondly, that some pragmatic conditions limit such claims in a legal dispute. Analyzing these conditions permits to highlight the connecting function of the argument from legislative intention in legal argumentation.
