This chapter addresses the use of new technology – especially artificial intelligence and machine learning – in the fight against international terrorism and takes into consideration legal issues arising therefrom. Algorithmic surveillance based on metadata, the removal of terrorist content online, facial recognition are examined as case-studies. In the concluding remarks, the author argues that the increasing role of technology in security practice, which necessarily implies reliance by public bodies on private entities, is changing some traditional concepts of constitutional law, such as sovereignty and state powers. As a matter of fact, private bodies are progressively taking over public functions, and this public-private partnership needs to be carefully monitored and tightly regulated.
