The paper examines the credibility of some of the indexes currently used in comparative analysis of labour market rigidity and employment protection, and the accuracy and soundness of the aggregates of social expenditures used to identify and classify different models of welfare state. The study points out the flaws of the accepted conclusions about differences and similarities existing among different systems, due to a lack of understanding of the specificity of the legal and socio-economic environment in which each institution is embedded. The paper concludes with some general remarks about the methodology of comparative institutional analysis and suggests that a joint effort of lawyers and economists can help reach better results through proper understanding of analogies and differences among different models of social protection.
