Le molte vie della ragione: principi e casi nel diritto penale

After some considerations on human and artificial intelligence, the work focuses on certain characteristics of human reason and intelligence, without neglecting its limits and considering the ways in which reasoning can justify a decision, especially a judicial one. To this purpose, the work outlines some inferential tools that must be distin guished from each other; then it discusses the relationship between principles and cases in criminal law, dealing with some theoretical approaches such as the ones of casuistry and interlegality; finally, it asks some questions on what appear to be significant differences between those theoretical approaches, recalling again the importance of clarify ing with which inferential tools judicial decisions can be rationally justified.
