This article describes the recent overruling by the U.S. Supreme Court of an important Supreme Court precedent, Chevron U.S.A., Inc. v Natural Resources Defence Council, Inc. (1984), which had introduced the rule of deference towards the discretion exercized by executive departments a n d independent agencies. The Court now prefers to adopt a more aggressive approach, declaring that in the future it will check all forms of administrative rules and regulations without giving up its judicial power. The principle of separation of powers is therefore going to be interpreted in a quite different way
