Il dinamismo del concetto di guerra: una sfida per il diritto

This Article analyzes how the traditional concept of war is undergoing changes toward a full metamorphosis. This transformation is due to at least two factors: first, the spread of global and atypical threats, such as international terrorism; second, technological breakthroughs. This results in new forms of conflicts and unprecedented strategies to fight them, often referred to as “hybrid wars”. Therefore, the Author claims that current legal frameworks – both at the international and constitutional levels – are unprepared to this scenario. In parallel, the Author suggests that these new challenges, including cyberspace and digital tools, should be an opportunity to re-adapt these legal frameworks to deal with these new threats.
