Law 234/2012 changed the mechanism for the fulfillment of the obligations deriving from Italy’s membership of the EU. The annual Community act (“Legge comunitaria”) has been replaced by two acts: the European delegation act (“Legge di delegazione europea”) and the European act (“Legge europea”). This work focuses on the first application of this newly established mechanism. The analysis of the European delegation act and of the European act passed in 2013 shows that both acts did not exploit all the tools made available by law 234/2012 for the implementation of EU law. It is argued that the new mechanism contributed to speed up the fulfillment of the obligations resulting from Italy’s membership of the EU, but did not help the Parliament to limit the Government’s prominent role in the implementation of EU law.

Abstract
Law 234/2012 changed the mechanism for the fulfillment of the obligations deriving from Italy’s membership of the EU. The annual Community act (“Legge comunitaria”) has been replaced by two acts: the European delegation act (“Legge di delegazione europea”) and the European act (“Legge europea”). This work focuses on the first application of this newly established mechanism. The analysis of the European delegation act and of the European act passed in 2013 shows that both acts did not exploit all the tools made available by law 234/2012 for the implementation of EU law. It is argued that the new mechanism contributed to speed up the fulfillment of the obligations resulting from Italy’s membership of the EU, but did not help the Parliament to limit the Government’s prominent role in the implementation of EU law.File | Dimensione | Formato | |
