This work, after highlighting the transformation of the notion of “war” following the end of World War II, analyses, from a comparative perspective, how the powers to resort to military force are regulated – at the constitutional and statutory level – in some selected Western democracies. The author points out that, although there is, de jure, a general trend towards the enhancement of parliamentary involvement in the decision to resort to armed forces, on the practical side the Executives can find ways to enhance their own role at the expenses of Legislatures. The considerations made in this contribution can be read in the light of events stemming from the recent invasion of Ukraine by Russia, occurred on 24 February 2022.
