The article begins by examining the political and institutional aspects of the right to secession from a comparative and international perspective. It then goes on to address the underlying elements which led to the creation of the state union between Serbia and Montenegro and examines the novelites contained in the 2003 constitution. The final part deals with the results of the referendum with which Montenegro left the union and became an independent state and what the future holds for this small country in the western Balkans.
